Introduction

Great Britain is under great concern about the continuous growing cases of lack of evidence. The criminal activities in recent times have evolved in a mysterious way where there is a serious crisis in the establishment of unyielding evidence. The Crown Prosecution Service of United Kingdom said that the justice is having “systematic” problems. There are several reasons for such situational crisis as the filing of false allegation, non-disclosure of evidence, withdrawal of charges, ending of trials, and finding insufficient evidence. According to Angela Rafferty QC of the Criminal Bar Association this situation is due to “lack of investment, training and attention to the criminal justice system”. While contradicting to that a CPS spokesperson gave a statement that number of cases that were not completed and dropped in the middle of prosecution because of insufficient evidence is only about 0.15% of the total number of prosecutions. It is estimated that the total number of such cases have increased as much as 70% in just two years which includes approximately more than 900 cases. The numerical value representing the number of cases that were completed, dropped down from 736,000 in 2013-14 to about 588,000 in 2016-17, obtained under the Freedom of Information Act. Over last few years, this scenario has made many people concerned apart from the executive bodies of government.

Cases

In certain sensitive cases such as rape, it is often encountered that the victim is not able to provide enough evidence against the culprit. This may be caused due to the delay of medical checkup, hesitation to file the case initially, sub-conscious or unconscious state of mind when the crime was taking place, lack of gathering evidence and many such. There are multiple cases where many innocent people are getting suffered for being falsely charged with a crime. This not only puts them under immense stress but also making them doubtful into people’s eyes. Till the time they get a clean chit, their normal life is ruined and perhaps it never again settles the same as before hampering their reputation.

Fact of concern

In fact, another issue that came up after this was even more disappointing and shocking. These events of failure to disclose many cases highlighted the fact that just like those cases there could have been more like this where accused were falsely charged and punished. The situation made many lawyers think about this matter deeply. There is a high possibility that many people previously had been punished for something which they are not even responsible for. This matter of concern made many other government officials to think about it and to go through cases in more details in search of proper evidence. And therefore, without any appropriate evidence and proof, they led to shutting many cases in order to avoid the punishment of any innocent individuals. Because the truest of all is that at least for the sake of humanity, even if a criminal is left free, an innocent man should never get punished for a crime that he or she has not committed.
